Likewise, they reiterated that the former president did not agree to the dissemination of the letter on social networks and recalled that, in December 2025, a similar correspondence delivered to his son was made public without the judicial authorities considering it a violation of the precautionary measures imposed.
In addition to the filial bond, Flávio is a lawyer formally constituted in his father’s defense team, which is why they allege that the suspension violates the right to communication between client and lawyer.
Therefore, the appeal asks the judge to restore Flávio’s family visits or, if he decides to maintain the restriction, to allow him to guarantee his right of communication as a defense lawyer, under the same conditions as the other members of the legal team.

The far-right leader, sentenced last September to 27 years in prison for attempted coup d’état, is serving his sentence at his home in Brasilia for health reasons, but under a series of restrictions. One of them is the prohibition of using social networks directly or through a third person.

For this reason, Moraes, in line with the Prosecutor’s Office’s brief, considered that the episode did not justify revoking the former president’s house-in-prison benefit, but rather imposing new restrictions on him to prevent any interference in this year’s presidential elections.
According to the magistrate, reading the letter contradicts the prohibition on the former president from disseminating messages through social networks, even through third parties, and “suggests“that this one had”full knowledge” that the letter was going to be disseminated on digital platforms.
The suspension of visits prevents Flávio from communicating with the far-right leader, who named him his successor after being convicted, for much of the campaign, since the first round of the elections is held on October 4.
