Supremo gives it to Carliz and his “Bad Bunny, baby”

The legal battle between Carliz De la Cruz Hernández and Bad Bunny took a significant turn after the Supreme Court of Puerto Rico determined that Carliz has the right to continue his claim for the unauthorized use of his voice in the famous phrase “Bad Bunny, baby.”

The decision overturns previous determinations that had limited the scope of the case and allows the lawsuit to continue. Carliz alleges that the recording of his voice was used in songs and commercial projects without his consent, which constitutes a violation of his rights.

The iconic phrase, which became one of the Puerto Rican artist’s most recognized sound signatures, appears in several songs and has been used as part of the #BadBunny brand identity.

With this determination, the highest judicial forum did not resolve the merits of the case or establish financial compensation, but it did conclude that Carliz can file a judicial claim for the use of his voice. It will now be up to the lower courts to evaluate the evidence and decide whether there was a violation of rights and, if so, what compensation is appropriate.

The case continues to be one of the most talked about litigation in the Latin music industry, due to the implications it could have on the use of voices, recordings and personal identity in musical productions.
